STUDIO POLICIES & FAQ'S

POLICIES

LIABILITY WAIVER

As the legal parent or guardian, I release and hold harmless Davis Dance Company, its owners and operators from any and all liability, claims, demands, and causes of action whatsoever, arising out of or related to any loss, damage, or injury, including death, that may be sustained by the participant and/or the undersigned, while in or upon the premises or any premises under the control and supervision of Davis Dance Company, its owners and operators or in route to or from any of said premises.

ASSUMPTION OF RISK

I understand that dance training requires sustained, repetitive, vigorous physical activity. I understand that participants engage in a broad range of movements, including bending, twisting, running, leaping and lifting, which place extreme demands on the human body, including stress of joints and ligaments, repetitive impact, and occasional falls, slips and collisions with other participants and objects. I also understand that dance instruction involves kinetic corrections that may include physically touching the student as part of regular class work or rehearsals. I understand that, despite precautions, there are inherent risks of serious personal injury involved in these activities. By signing this release form, I acknowledge and assume all risks of participation in programming taking place at Davis Dance Company.

MEDICAL EMERGENCIES

The undersigned gives permission to Davis Dance Company, its owners and operators to seek medical treatment for the participant in the event they are not able to reach a parent or guardian. I hereby declare any physical/mental problems, restictions, or condition and/or declare the paricipant to be in good physical and mental health.

LATE ARRIVAL

Lateness is strongly discouraged, as it is disruptive to classes already in progress and could result in injury to students. If a student is more than 15 minutes late to class, they may be asked to sit and observe. This is for safety as well as dance class etiquette purposes. If the dancer misses the warm up portion of class, it is unsafe for them to participate in the rest of the class activities.

COVID-19 WAIVER

ASSUMPTION OF THE RISK AND WAIVER OF LIABILITY RELATING TO CORONAVIRUS/ COVID-19: The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies have put in place recommended social distancing, occupancy restrictions and guidelines for businesses to follow. Davis Dance Company has put in place preventative measures to reduce the spread of COVID-19. Davis Dance Company will be implementing all recommendations from NC state officials; reference our Sanitation Practices & Social Distancing Guidelines available on our website. Davis Dance Company will make every effort to keep our studio sanitized and to prevent symptomatic employees and dancers from entering the building. However, COVID-19 has been proven to be asymptomatic in some persons. Therefore, Davis Dance Company cannot guarantee that you or your child(ren) will not become infected with COVID-19 or any other virus. Attending Davis Dance Company could increase your risk and your child(ren)'s risk of contracting COVID-19. By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending Davis Dance Company and that such exposure or infection may result in personal injury, illness, permanent disability, or death. By signing this agreement, I agree that my child and any accompanying persons will not enter Davis Dance Company if we exhibit any of the following new or worsening signs or symptoms of possible COVID-19: A temperature greater than 100.4 degrees Fahrenheit, cough, shortness of breath or difficulty breathing, other respiratory symptoms, or at least two of the following symptoms: chills, repeated shaking with chills, muscle pain, sore throat or new loss of taste or smell. I also agree that, neither my child(ren) nor any accompanying adult will enter Davis Dance Company if we have had known close contact with a person who is lab-confirmed to have COVID-19. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)'s attendance at Davis Dance Company. On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless Davis Dance Company, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Davis Dance Company, its employees, agents, and representatives, whether a COVID-19 or other currently unknown virus infection occurs before, during, or after participation in any Davis Dance Company program or class.

PHOTOS AND VIDEOS

The undersigned gives permission to Davis Dance Company, its owners and operators to use photos or videos of the participant on their website, Facebook, other social media sites, and/or in ads or for marketing purposes.

DDC does not allow parents into the studio to observe. Instead, parents are welcome to view their dancer's class(es) from the live video feed in the lobby or from their mobile device through Spot TV. This device does not save or record classes. This video feed is password protected and only available during your child's class time. Parents will be given access to create a Spot TV account to be able to stream their classes.

SCHOOL YEAR PROGRAMS BILLING/PAYMENT
Tuition for school year programs is due by the 1st of each month and is automatically drafted from my credit card on file. I understand that if my credit card is declined and I do not pay my tuition by the 5th of the month, there will be a $15.00 late fee applied to the account balance. No refunds are given once tuition has be billed/drafted for the month. All costume and recital fees are non-refundable. We offer prorated tuition if you register late in the month. Prorating is only good for students that REGISTER once the billing cycle has already begun- not for already registered students. If a registered student misses a class during the month, they are able to make up the class, but will not be refunded for the missed class.

School year programs require a $35 annual registration fee. $20 for each additional student.

SERVICE FEES

EFFECTIVE 7/1/24

WITHDRAWAL

I understand that if I wish to withdraw my student from class, I must do so by emailing the studio at office@davisdancecompanycom prior to the 1st of the month, or before the Summer program has taken place. You must complete the drop form before the 1st sent to you via email for your drop to be processed. Once tuition is drafted, it is non-refundable. I also understand that if the recital costume has already been ordered and I withdraw my dancer, I am responsible for payment in full. I understand that if I opted into a performance, but wish to drop the class before the performance, I will still be responsible for performance fees. If a student withdraws and then registers again within the same dance year (August - May) the registration fee will be charged again.
